Refund Requests / Refund Fees:
- Refund requests must be submitted within twenty-four (24) hours of service delivery.
- Refunds are only available to new clients on their initial purchase and only if the service remains unused.
- No refunds are offered on promotions, custom discounts, add-ons, or pre-ordered services.
- Cryptocurrency payments are final and may only be issued as account credit.
- A twenty percent (20%) refund processing fee applies to PayPal and Stripe payments.
- Any violation of the Terms of Service or Acceptable Use Policy voids refund eligibility.
Affiliates:
- Affiliate payouts are issued exclusively as Hosting Bot, LLC account credit.
- Cash or external currency payouts are not available.
Cancellations:
- Cancellation requests must be submitted through the client portal.
- Cancellations must be received at least seven (7) days prior to the renewal date.
- Failure to cancel before invoice generation constitutes a Terms of Service violation.
- Invoices may be automatically charged once generated.
- Late cancellations may result in suspension, termination, and collections activity.
End of Life Products:
- Hosting Bot, LLC may add, replace, or discontinue products at its discretion.
- When feasible, sixty (60) days’ notice will be provided.
- Migration assistance may be offered when applicable.
Chargebacks and Disputes:
- Initiating a chargeback or dispute authorizes Hosting Bot, LLC to share account information with payment processors.
- Information may also be shared with fraud-prevention services and law enforcement agencies.
- Fraudulent disputes may result in immediate termination and permanent service denial.
Cryptocurrency Payment Policy:
- All cryptocurrency transactions are final.
- Refunds or cancellations will be issued as account credit only.
Promotions:
- Promotional offers may be modified, limited, or terminated at any time.
- Abuse or circumvention of promotions may result in immediate termination without refund.
Price Match:
- Price matching is subject to verification.
- All price matches are granted at Hosting Bot, LLC’s sole discretion.
Price Adjustments:
- Service plans and pricing may change at any time.
- Changes apply only to future invoices.
- Previously paid invoices will not be modified.
Country Block Policy:
- Service availability is not guaranteed in all countries or networks.
- Relocation requests must be submitted via support ticket.
- Pricing may vary between data centers.
Legal Contact:
- Hosting Bot, LLC may cooperate with law enforcement when required.
- All communications are considered confidential unless disclosure is legally required.
- Hosting Bot, LLC retains sole authority to start, stop, suspend, access, or modify services.
Rent to Own (RTO) Policy:
- Rent-to-Own servers remain the sole property of Hosting Bot, LLC until all conditions are met.
- Twelve (12) consecutive months of uninterrupted service are required.
- Any abuse, suspension, or Terms of Service violation voids RTO eligibility.
- All RTO payments are non-refundable.
Colocation Contractual Agreement:
- All colocation services ordered after November 2023 require a twelve (12) month minimum term.
- Early termination accelerates the remaining contract balance.
- Waivers require written approval from Hosting Bot, LLC management.
Unmetered Policy:
- Unmetered services are billed using the 95th percentile method.
- Network usage is continuously monitored.
Bandwidth Overage & IP Blacklist Policy:
- Bandwidth overages are billed at $5.00 per TB.
- Blacklisted IPs incur a $15.00 per-IP fee.
- Subnet bans incur a $150.00 fee.
- ASN-level bans incur a $1,500.00 fee plus remediation costs.
Termination:
- Hosting Bot, LLC may suspend or terminate services at its sole discretion.
- Any Terms of Service or AUP violation may result in immediate termination.
Threats / Staff Abuse:
- Threats, harassment, or abusive conduct toward staff are prohibited.
- Violations result in immediate termination of all services.
Forgery, Impersonation, and Invalid Information:
- Impersonation or falsified account information is prohibited.
- Violations result in immediate termination without refund.
Unauthorized Access:
- Unauthorized system access, network abuse, or denial-of-service activity is prohibited.
- Violations result in immediate termination.
Fraud:
- Fraudulent activity is strictly prohibited.
- Violations may be reported to fraud-prevention databases.
Backups and Data:
- Clients are solely responsible for maintaining backups.
- Hosting Bot, LLC is not liable for data loss under any circumstances.
Service Suspension:
- Unpaid or non-compliant services may be suspended or terminated.
- Customer data may be removed after termination.
Banned Services:
- Illegal, abusive, or resource-intensive activities are prohibited.
- Verified abuse incurs a $15.00 fine per incident, due immediately.
Indemnification:
- Clients agree to indemnify and hold Hosting Bot, LLC harmless from claims arising from service use.
Limitation of Liability:
- Hosting Bot, LLC is not liable for direct or indirect damages.
- Liability is limited to service termination.
Disclaimer of Warranties:
- Services are provided “as-is” and “as-available.”
- No warranties are expressed or implied.
Governing Law:
- These Terms are governed by the laws of the State of Texas.
Collections:
- Unpaid balances may be sent to collections.
- Chargebacks on collection invoices may incur fees up to $50.00 per occurrence.
Entire Agreement:
- These Terms constitute the entire agreement between the parties.
- Modifications require written authorization from Hosting Bot, LLC.
